Streszczenie
Artykuł ukazuje zagadnienia związane z zabezpieczaniem oraz interpretacją śladów biologicznych na użytek wymiaru sprawiedliwości. Celem tego opracowania jest dokonanie ustalenia, czy na gruncie badania śladów biologicznych istnieją konkretne przesłanki dotyczące technicznego i procesowego zabezpieczania śladów na miejscu zdarzenia, a także czy mogą się pojawiać trudności interpretacyjne w odniesieniu do dowodów przedstawianych w procesie karnym. Niniejszy artykuł prezentuje praktyczne kwestie czynności podejmowanych na miejscu zdarzenia, które zobrazowane są egzemplifikacjami wskazującymi na trudności związane z interpretacją dowodów w postaci śladów biologicznych.
Abstract
The article is devoted to issues related to collecting and interpreting biological traces for use in the criminal justice system. The purpose of this paper is to determine whether, on the subject of the examination of biological traces, there are specific considerations regarding the technical and procedural protection of traces at the crime scene, as well as whether interpretative difficulties may arise in relation to the evidence presented in the criminal trial. The paper presents practical issues concerning the undertaking of activities at the crime scene, which are illustrated with examples of the difficulties associated with the interpretation of biological trace evidence.
